("Provider") grants you (the "User") a license (an "Account") to use the website DOCSMIT.COM (the "Site") provided you agree to abide by the terms of this Agreement. Your use of the Site indicates your acceptance of all of the terms of this Agreement. This license allows the Account to be used by one user only, however this user may use the Account on more than one computer. The User agrees that Provider may change the terms of service, the nature of the services provided at the Site (if any), and the costs of those services at any time and without prior notice. 2) THE PROGRAM: You acknowledge that you do not become the owner of or have any interest in the Site (software, programs and/or documentation). You agree not to transfer, rent, lease, sub-license, reverse engineer, modify, or share all or any portion of the Site with any other person or firm. 3) LIMITED WARRANTY: While we have attempted to ensure the reliability of the Site, the Provider cannot assume any liability for damage that occurs because of use of this program, whether or not in accordance with the instructions or specifications. It is not possible to guarantee the program's performance or availability under all circumstances, at all times, with all hardware and software configurations, and with any user data, programs, or series of commands. You agree that regardless of the form of any claim, the Provider's liability for any damages or loss to you or anyone else shall not exceed the price paid for the transaction that gives rise to the claim. NO OTHER WARRANTIES: Except for the warranty described in this section, there are no warranties expressed or implied, including but not limited to, implied warranties of merchantability or fitness for a particular purpose, and all such warranties are expressly and specifically disclaimed. 4) PRIVACY: Docsmit will use its best efforts to limit the ability to obtain the content of sent communications that have been paid for to the parties to those messages. Information relating to the User's viewing of messages and downloading of attachments will be recorded and that information, as well as other information, may be made available to others. 5) CONTENT: The User represents that he will not use, or encourage, promote, facilitate or instruct others to use, the Account or the Site for any illegal, harmful or offensive use, or to transmit, store, display, distribute or otherwise make available content that is illegal, harmful, or offensive. Prohibited activities or content includes, but is not limited to: Illegal Activities, Harmful or Fraudulent Activities, Infringing Content, Offensive Content, Harmful Content. The Provider may investigate any alleged or suspected violation of these terms, including review of message content. Violation of any of these terms may result in termination of the Account and the preservation and/or limiting of access to data, at the unilateral discretion of Provider. 6) BEHAVIOR: User represents that he will not distribute, publish, send, or facilitate the sending of unsolicited mass e-mail or other messages, promotions, advertising, or solicitations (i.e. “spam”), (the determination of which will be solely at the discretion of the Provider). User will not violate or act so as to cause Provider to violate the CAN-SPAM Act. The User also represents that he will make no efforts to access data other than that which belongs to him. 7) AVAILABILITY: User recognizes that at times the Site may be unavailable and that there will be both scheduled and unscheduled unavailability. 8) CREDITS: User accepts and acknowledges that once funds have been paid to Docsmit to purchase credits to be held with Docsmit they will not be refunded. 9) NO LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES: In no event shall the Provider, its principals or its suppliers, if any, be responsible for any special, incidental or consequential damages whatsoever (including, without limitation, damages for lost profits, business interruption, loss of information, or any other loss) arising out of the use or the inability to use the Site, even if Provider has been advised of the possibility of such damage. 10) CHANGES: These Terms of Service will be provided at https://secure.docsmit.com/TOS.php and may change from time to time and without notice.
